Are you the spouse of someone working in the U.S. on an H-1B visa? The good news is you may be eligible for an H-4 EAD work permit , allowing you to legally work, freely seek employment, or even start a business in the U.S.
To obtain an H-4 Early Admission Allowance (EAD), you need to submit Form I-765 to the U.S. Citizenship and Immigration Services (USCIS), along with the required supporting documents and the prescribed fee. Only when USCIS approves and grants the EAD will you officially be allowed to begin work in the United States.
This article will provide detailed, easy-to-understand instructions on:
-
Requirements for applying for an H-4 EAD
-
Documents and paperwork to prepare
-
Steps to file Form I-765
-
Important notes to avoid mistakes.
If you're looking for accurate and up-to-date information to start a legal career in the U.S. as an H-4 dependent spouse, then this article is for you.
Part 1: How to correctly fill out Form I-765 to apply for an H4 EAD
Step 1: Requirements for applying for an H-4 EAD in the US
Not all H-4 dependent spouses are eligible to apply for an H-4 Employment Authorization Document (EAD). You are only eligible if you meet one of the following criteria:
-
Your spouse, who holds an H-1B visa, has been granted residency under either section 106(a) or 106(b) of AC21.
-
Or your spouse (who holds an H-1B visa) is the beneficiary of the approved USCIS Form I-140 (the I-140 is the application for a Green Card for a skilled worker).
Advice from real-world experience :
-
Before filing, carefully check your spouse's H-1B or I-140 application status to ensure you are eligible.
-
If you are unsure about the status of your case, you can call USCIS directly at 1-800-375-5283 for assistance.
-
In complex cases, consult an experienced immigration lawyer to avoid mistakes that could delay or reject your application.

Step 2: Download the latest I-765 form and instructions.
When applying for an H-4 EAD work permit, the most important first step is to download Form I-765 and its accompanying instructions from the official USCIS website at: https://www.uscis.gov/i-765 .
Some practical notes:
-
Always use the latest version : USCIS regularly updates its forms. If you submit an outdated version, your application will be rejected , and you will have to start over, wasting time and money.
-
Read the instructions carefully : The accompanying documents contain complete and detailed instructions. Incorrect or incomplete information may cause your application to be delayed or rejected .
-
Many applications are returned due to minor errors such as incorrect dates, wrong signatures, or using outdated versions of the form. Therefore, double-check everything before submitting.

Step 3: How to fill out the I-765 form for an H-4 EAD application.
When filling out Form I-765, you need to provide your personal information and that of your spouse (the H-1B visa holder). There are two ways to complete the form:
-
Fill it out directly on the computer , then print it out and sign it.
-
Print the form in white and write it by hand , remembering to use black ink so that USCIS can easily read it.
Some important notes from practical experience:
-
Provide complete and accurate answers : USCIS may reject your application if the information is incomplete or incorrect.
-
If the question does not apply , please write “None” or “N/A” . Do not leave it blank.
-
Check carefully before submitting, especially the dates, signatures, and information regarding your spouse's visa status.

Step 4: Sign and date the I-765 form.
After completing Form I-765 to apply for an H-4 EAD work permit, you need to take the final important step: signing and date the application .
Some important notes:
-
Carefully review the entire form before signing to ensure there are no spelling errors, incorrect information, or missed answers.
-
Sign only in black ink . USCIS will not accept photocopied, scanned, or typed signatures.
-
If you fill out the form on a computer, print it out and sign it by hand .
-
A small mistake like forgetting to sign your name can cause your application to be returned and take weeks to process.
Many documents are delayed simply because of missing signatures or signatures in the wrong place. Therefore, after signing, have someone else double-check the document before submitting it.

Part 2: Preparing your H4 EAD application: List of required documents
Step 1: Provide evidence of your H-4 status.
When filing Form I-765 for an H-4 EAD work permit, you must demonstrate that you hold legal H-4 status. Common documents include:
-
A copy of Form I-94 (Arrival/Departure Record) showing your entry and H-4 visa status.
-
Or a copy of Form I-797 (Notice of Action) confirming the approval of the I-539 petition for or extension of H-4 status.
Some important notes:
-
Only use valid documents . If your I-94 or I-797 has expired, your application may be denied.
-
Please check the deadline carefully before submitting to avoid wasting processing time.
-
In reality, many applications are delayed simply because applicants forget to renew their H-4 before filing their I-765.

Step 2: Submit a copy of your photo ID.
To prove your identity when applying for an H-4 EAD work permit, you need to submit a copy of a government-issued photo ID . Commonly accepted documents include:
-
Passport (personal information page/biometric page).
-
My US visa is still valid .
-
Your national identity card or citizen's identification card from your country (if still valid).
-
Birth certificate with photo (if your country issues this type of certificate).
-
Old EAD if you have ever been granted a work permit before.
Practical note :
-
Always use clear, complete, and valid copies.
-
If your passport is about to expire, you should renew it soon to avoid any impact on your application.
-
USCIS generally prefers passports or visas because they are common documents and easier to verify.

Step 3: Submit a copy of the marriage certificate.
Because H-4 status is directly dependent on marriage to an H-1B visa holder, USCIS will require you to prove this relationship. Therefore, in your H-4 EAD application, you need:
-
A copy of the marriage certificate to confirm the husband/wife relationship.
-
If your marriage certificate was issued abroad and is not in English , you must include a certified/notarized translation .
Practical experience :
-
Many applications are flagged for additional information simply because uncertified translations were submitted. Therefore, use a certified translation that meets USCIS standards from the start.
-
Keep both the original and a copy, as USCIS may sometimes request the original during processing.

Step 4: Provide evidence of eligibility for the H-4 EAD application.
For USCIS to approve your I-765 petition, you need to demonstrate that you genuinely qualify for an H-4 Early Admission Document (EAD). Commonly required documents include:
-
Evidence of spouse's H-1B status , for example:
-
Copy of I-797 Approval Notice (H-1B approval).
-
A copy of a valid H-1B visa .
-
A copy of the spouse's I-94 form.
-
-
If your application, based on Form I-140 (Appeal for a Green Card for Workers), has been approved or is pending, you need to submit:
-
A copy of Approval Notice I-140 ; or
-
A copy of the Receipt Notice if the I-140 is still pending.
-
Practical experience :
-
Many applications are delayed simply because applicants forget to include the Approval Notice or submit blurry, illegible copies.
-
Always prepare a clear, valid copy .
-
If you are unsure which documents you need to submit, call USCIS at 1-800-375-5283 or consult an experienced immigration lawyer to avoid mistakes.

Step 5: Prepare a passport photo to submit with your H-4 EAD application.
For your H-4 EAD work permit application, you need to submit two identical passport-sized photos that meet USCIS standards.
Some important notes:
-
Take the most recent photos : Even if you have photos taken a few months ago, take new ones to ensure they are up-to-date.
-
Shooting locations : You can have photos taken at a professional photo studio, a large pharmacy, or at printing and delivery services in the US.
-
Technical requirements according to US standards :
-
Color photos, printed on high-quality photo paper.
-
Size: 2 x 2 inches (5.1 cm x 5.1 cm).
-
Distance from chin to top of head: 1 – 1.375 inches (2.54 – 3.49 cm).
-
White background, face looking straight ahead, no glasses or coverings.
-
Practical experience :
-
Incorrect photos are one of the common reasons USCIS requests additional documentation.
-
Make sure to clearly state to the photo studio that the photos are for submission to USCIS (Immigration) so they can take them according to the required standards.

Part 3: Submitting the H4 EAD Application: Instructions on paying the fee, filling out Form G-1145, and submitting the application.
Step 1: Determine the address for filing your I-765 application.
The address where you mail your I-765 petition will depend on the eligibility category you selected in Question 16 of the form.
Steps to follow:
-
Check section 16 on your I-765 form to find out which category you fall under.
-
Access the official USCIS website at: https://www.uscis.gov/i-765-addresses .
-
Select the correct eligibility category to get the exact address where you need to submit your application.
Practical experience :
-
If you send your application to the wrong address, USCIS will return it and you'll have to resubmit it from scratch → this is both time-consuming and risks slowing down the process.
-
You should print the address directly from the USCIS website instead of relying on other sources (because addresses may change over time).
-
When sending documents by mail, choose a service with a tracking number for easy monitoring of delivery status.

Step 2: Attach the G-1145 notification form.
If you wish to receive email or SMS notifications as soon as USCIS accepts your I-765 H-4 EAD petition, please include Form G-1145 – E-Notification of Application/Petition Acceptance .
-
Download the latest form from the official USCIS website: https://www.uscis.gov/g-1145 .
-
Fill in your contact information (email and mobile phone number).
-
Attach Form G-1145 to the first page of your application before submitting it.
Practical experience :
-
This is the quickest way to know if your application has been received by USCIS without waiting for a physical letter.
-
This notification only confirms receipt , it does not constitute approval.
-
Many applicants forget to attach the G-1145 form, resulting in long wait times for information on their application status – so prepare it in advance.

Step 3: Prepare the filing fee for Form I-765 (H-4 EAD).
When applying for an H-4 EAD work permit, you need to prepare the fees as required by USCIS.
-
The filing fee for Form I-765 is $410 .
-
In some cases (for example, the spouse or unmarried children of the I-140 petitioner) may be required to pay an additional $85 biometric fee .
Accepted payment methods :
-
Personal checks or money orders , withdrawn from a US bank and paid in USD.
-
Write a check payable to: US Department of Homeland Security (do not use abbreviations).
-
On the memo line of the check, write: “Form I-765” .
-
The date on the check must be in the American format: month/day/year (MM/DD/YYYY) .
Practical experience :
-
Many applications are returned simply because the beneficiary's name is misspelled (for example, using the abbreviation "DHS" instead of the full name).
-
Always attach a check or money order at the top of your application to make it easier for USCIS to process.
-
If you use a money order, keep the original receipt for tracking purposes.

Step 4: Arrange the I-765 documents in the correct order.
To expedite USCIS processing and avoid requests for additional information, you should organize your H-4 EAD application documents in the recommended order:
-
Check or money order for fee payment – placed with the application.
-
Form G-1145 (if you wish to receive notifications via email/SMS).
-
Form I-765 has been completed and signed.
-
The supporting documents should be arranged in the order listed in the I-765 form instructions (e.g., I-94, I-797, marriage certificate, passport, visa, passport photo, H-1B spouse documents, etc.).
Important note :
-
Submit only clear copies of the original documents. If you submit the originals, they will become USCIS records and will not be returned to you .
-
Use paper clips instead of staples so that USCIS can easily disassemble the package during processing.
-
Double-check all the documents before putting them in the envelope and sending them out.
Organizing your documents neatly and in the correct order helps USCIS process them faster and reduces the risk of your application being returned or delayed.

Step 5: Send the I-765 form to the correct USCIS address.
After preparing all the necessary documents for your H-4 EAD application, you need to send the entire package to the appropriate USCIS address.
Some important guidelines:
-
Use a Manila envelope that is large enough to hold your documents without having to fold the papers.
-
You can send it via US Postal Service (USPS) or private courier services such as UPS or FedEx .
-
The filing address varies depending on whether you use USPS or a private courier service. Therefore, please check the official USCIS website carefully before submitting.
-
Always double-check the address . If you send it to the wrong address, your application will be returned and you will have to resubmit it from the beginning.
Practical experience :
-
It's advisable to choose a shipping service that provides a tracking number for easy monitoring of your documents.
-
Write the USCIS address clearly on the outside of the envelope and keep the shipping receipt as proof.
-
If your visa is about to expire, you should choose a courier service to avoid delays.

Step 6: Monitor and wait for USCIS to process your application.
After submitting Form I-765, you will need to wait for USCIS to review it .
-
Processing time : It typically takes several months for USCIS to review and issue the EAD card.
-
During this time, you are not permitted to work until you receive a valid EAD card.
-
If your case has been pending for more than 90 days without a result, you can submit a case inquiry to the USCIS center handling your case.
Practical experience :
-
After receiving the Receipt Notice, you can track your case status online on the USCIS Case Status page.
-
Always keep the receipt number for reference and contact when needed.
-
If your application is experiencing unusual delays, you can seek assistance from an immigration lawyer to submit an inquiry or escalate your application.
